I, hereby known as renter, agree to rent from, , hereinafter known as owner, the Vacation Property located at 10837 Elm Drive, Alta Sierra, CA 95949.
PAYMENTS
We accept VISA, Mastercard, Cashiers checks and money orders. We will accept personal checks if they are received 30 days before check in. Via our website you can also use Visa or MasterCard credit cards for making payments. Security Deposit is due when making your reservation. Your Full Rental Payment is due within one week of your arrival date.
SECURITY DEPOSIT
The security deposit includes a non-refundable cleaning fee. The remainder of your security deposit will be held pending determination that upon departure you have left the unit and contents in the same condition they were upon arrival, and there are no outstanding charges i.e. extraordinary cleaning services, repairs, etc. that are not considered normal wear and tear, at which time it will be returned to you, less any charges, within thirty days from departure. Pets are welcome with owners permission. Full rental payment and this agreement must be received prior to check-in. If determined that smoking or unauthorized pets were allowed inside the home, your entire security deposit will be forfeited.
RENTAL PAYMENT
Your full rental payment is due within one week of your arrival date. You may send or use our website within one week of your arrival date to make rental payment.
CANCELLATION & REFUNDS
The policy is as follows: Greater than 30 days before your arrival date - Security deposit will be refunded less a $10 processing fee. 30 days or less before arrival – forfeiture of entire rental amount unless property can be re-rented for an equivalent period or greater. Then only cancellation fee will apply.
CHECK-IN/OUT
Check-in is 3:00 PM. Check-out is 11:00 AM. Any exceptions must have prior approval from manager or owner. After you have made your final rental payment, please call the manager to make arrangements for key access before your arrival.
RULES & REGULATIONS
In order to preserve the integrity of the unit, we ask that it be occupied in a quiet and dignified manner, protecting the premises and its contents against damage, loss or theft with adherence to all the rules and regulations of the applicable Alta Sierra Community and surroundings.. Its property owners all inclusive will not be liable for any claims, suits, damages, costs, losses and expenses arising from injury to any person or property occurring on or about the premises relating to the rental of this property. SMOKING INSIDE THE HOME IS NOT PERMITTED UNDER ANY CIRCUMSTANCES. Tenants and all other occupants will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following:
A. Occupancy exceeding the unit's maximum capacity of six (6) adult persons, (may have 10 persons if 4 are minors (under 17 years of age)), or as you stated and paid for on the reservation confirmation, without prior permission.
B. Using the premises for any illegal activity including, but not limited to, the possession, serving or consumption of alcoholic beverages by or to persons less than 21 years of age.
C. Causing damage to the premises rented or to any of the neighboring properties.
D. Any other acts which interferes with neighbors' right to quiet enjoyment of their property.
E. Unauthorized access and/or tampering of any storage facilities located on premises. These facilities are NOT included in this agreement and are exclusively used by owner.
DISTURBING THE PEACE
Please respect our neighbors and properties. Quite Hours is from 9pm and 8am Weekdays (Sun-Thu) and 10pm to 8am Weekends (Fri-Sun). During Quite Hours, keep all noise levels down and excess visitors and vehicles must leave property. Trespassing, consistent loud noises, poorly controlled fires or animals, or other actions that generate complaints from our neighbors will not be tolerated. Should we receive a complaint from a neighboring property, the following complaint procedure will be followed:
COMPLAINT POLICY AND PROCEDURE
FIRST COMPLAINT: You will be given a warning by phone. If a phone call is not successful, you will be visited personally by our manager and charged a $40 "call-out" fee, which will be withheld from your security deposit.
SECOND COMPLAINT: If you receive another warning call or service call fee, you will, in addition, be black-listed from renting any Co-op controlled vacation rental in the community.
THIRD COMPLAINT: Authorities will be called to the property for Disturbing the Peace under Penal Code 415, and you will be required to vacate the property in addition to forfeiting all rents and deposits.
THIS IS A HEAVILY WOODED AREA, PLEASE TAKE EXTREME CARE WHEN HAVING A FIRE. PLEASE NEVER LEAVE A FIRE UNATTENDED AND COMPLETELY EXTINGUISH IT AFTER USE!
DEPARTURES
The property must be vacated by 11:00 AM on the date indicated in order to make it available for future guests. Unless otherwise extended with agreement from manager, the owner or manager shall have the right to take immediate possession of the unit at check-out time. Please leave the keys where designated and lock the cabin upon leaving.
TELEPHONE
The calling plan for the cabin's telephone allows for unlimited local calling. Long Distance is not included, and a calling card will be needed. Please do not make any calls outside the continental United States, otherwise you are welcome to use the telephone freely.
KEYS
Replacement cost: $10 each
PETS
Dogs are welcome with owners approval. Any pets found inside premises without prior permission, or any complaints from neighbors regarding excessive noise or other nuisances may be cause for immediate termination of the lease and forfeiture of the renter's entire security deposit. PLEASE pick up after them and use THIER beds not the cabin beds. Any clean up of waste, hair and washing or replacement of comforters, furniture or carpets will be deducted from your security deposit.
CLEANING
The property will be inspected, sanitized and cleaned after your departure. The cleaning fee you have paid will provide for three hours of normal cleaning (for 6 beds), so that you can enjoy your vacation up to the last moment. YOU ARE REQUIRED to leave the property in the same general condition that you received it by making sure, dishes are done and put away, and the home is generally picked up and ready to be vacuumed, dusted and sanitized. If additional cleaning is required, appropriate charges will be deducted from your security deposit.
TOILETS
Our bathroom facilities are on a septic system which is very sensitive to excess water flow and to what is flushed down the toilets. Please only flush toilet paper. Do not flush paper towels, wipes, napkins, feminine hygeine products or toys down the toilet.
ADDITIONAL TERMS AND CONDITIONS
The undersigned, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Owner from any and all claims, demands and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result of, or in connection with the occupancy of the premises and agrees to hold Owner free and harmless of any claim or suit arising therefrom. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entitled to recover reasonable attorney fees and costs.
By entering into this rental agreement, you hereby authorize the owners of McWuc's Cabin to assess charges to your credit card for theft, excessive cleaning, or damages beyond normal wear and tear. In the event that theft, or damages beyond normal wear and tear occur, or excessive cleaning is required, a detailed accounting and invoice will be sent to you.

ALTA SIERRA RECEIVES SNOW EVERY YEAR. WEATHER CAN BE UNPREDICTABLE. PLEASE PREPARE YOURSELF WITH 4 WHEEL DRIVE AND CHAINS DURING YOUR WINTER STAY. REFUNDS/CREDITS CANNOT BE GIVEN FOR WEATHER, ROAD OR SNOW CONDITIONS, OR BECAUSE OF INTERRUPTION OF UTILITIES RESULTING FROM WEATHER CONDITIONS!
This rental agreement must be accepted and received prior to your arrival date. I have read and agree to this rental agreement.
